Resignation - Leaving the company
I want to ask what kind of letter should I write to get a release — should it be a resignation or a request for release because our company is not giving the release. Do I need to file a case with the Labor Dept since I have been working with my company for 5 years now and I have got a new job offer from another company? Is a 2-month vacation leave included in the 3-month notice after resigning from the company?

Answer: The company can’t stop you from leaving unless you have a time-bound contract. All you have to do is resign with a three-month notice. If it is not accepted, you can take a copy of the resignation and file a complaint with the Labor Dept in your area.
On the issue of leave during the notice period, it all depends on a mutual agreement between you and your firm. There is no law against it but if the company doesn’t agree you can’t go.
