3-month notice for term of contract is not specified

Is a 3-month notice compulsory for the employee/employer who has a fixed time 1-year contract? If both parties do not give notice until the completion of contract what will be the result?
Will the pending salary, renumeration, indemnity etc be cleared before or after the release?

Answer
: Article 44 of the Kuwait Labor Law clearly states that the notice period is only for those employees/employers in which the term of contract is not specified.
If no notice is given, the contract is automatically terminated but if both parties continue to implement the contract after its expiry without formal renewal, the contract shall be deemed to have been renewed for a similar period with the same conditions, unless both parties agree to renew the contract under different conditions.
Secondly, on the issue of indemnity or any other dues, these — under the law — are required to be made before the work permit is transferred or cancelled.
Some employers ask you to sign a document saying you have received your dues before you cancel the work permit but in this case you are taking a risk because the employer could then say that he has already paid you everything.
