Indemnity Calculation & release

I work in a jewellery shop. I have been here on a sponsor’s visa. I have been working here for 11 years. When I joined my salary was KD 130, now it is KD 300 but on the salary certificate it is KD 250. If I want to take a release from my sponsor is it possible as it’s already 11 years. If I have to claim my indemnity can you please calculate how much should I get in total?

First of all there should be no problem in getting your release as you have already worked a lot of years for the same sponsor – normally you would be able to get a release if you had worked one year after joining the firm on a local transfer and after three years if you had been hired from abroad.

On the question of indemnity you should get your full indemnity for 11 years as the requirement to get the full indemnity is ‘over 10 years service.’ It should also be calculated on your last salary i.e. KD 300. It doesn’t matter if KD 250 is mentioned on the work permit … you must be having salary  slips or bank statements to show that you are getting KD 300.

So your indemnity will be as follows:

First 5 years 15 days each year = 15x5 = 75÷26=2.88x300=864.
Next 6 years at one month’s salary for each year = 300x6 = KD1,800.
Total indemnity = KD 1,800+KD 864 = KD 2,664.
