Court acquits ‘loan shark’ for lack of evidence, denial Ex-wife deserves Amiri grant: lawyer

KUWAIT CITY, June 24: The Misdemeanor Court presided over by Judge Bader Turki Al-Wazzan acquitted a citizen who was accused of taking advantage of the plaintiffs’ difficult financial situations by loaning them money at an exorbitant interest rate.
According to the case files, the defendant loaned the two plaintiffs KD 10,000 in 2009 by giving a cheque of KD 5,000 to each plaintiff with the agreement that they will pay back the amount in monthly installments of KD 350 through their agents.
However, the debtors were unable to pay the monthly installment due to their difficult financial situations. The creditor then filed a case at the Public Prosecution against the debtors, which he later withdrew after negotiating with the debtors to sign a cheque of KD 5,000 and a promissory note from each of them.
Defense lawyer Ayed Mahdi Al-Rashidi argued that the charges cannot be substantiated due to the lack of evidences. Furthermore, the defendant denied all charges.

Case rejected: The Court of First Instance rejected the case filed by a citizen against his ex-wife in which he demanded the latter to give him KD 5,000 from the Amiri grant that she received illegally for the care of their children since he had the custody of their children.
Defense lawyer Abdulmohsin Al-Qattan pleaded the court to nullify the case, requesting the case to be referred for investigations and the plaintiff to pay the legal charges.
Lawyer Al-Qattan told the court that his client deserves to receive the Amiri grant for the care of her children as she has fulfilled all the required conditions for the custody to be granted to her, adding that mothers are usually more capable of taking care of young children.

Citizen acquitted: The Court of Appeals presided over by Judge Najeeb Al-Mulla overruled the verdict issued by the Court of First Instance which had sentenced a Kuwaiti citizen to 3-year imprisonment with hard labor for assaulting an Egyptian expatriate with an electronic device and injuring his nose.
The court ordered the defendant to file a written pledge of proper conduct and behavior and a fine of KD 300.
Attorney Ali Al-Wawan pleaded the court to acquit his client and cancel the appealed verdict as the accusation was malicious and the evidences were suspicious.
