Questions on Indemnity
Please can you advise if I am entitled to any indemnity. I have been working for a Kuwait company since Jan 2011 (18 months in total) on a full time contract. I have handed in my notice and will be leaving Kuwait.
Am I entitled to any indemnity? (as I have less than 3 years service)
Name withheld
Answer: No, you are not entitled to any indemnity if you resign before you complete three years service. The only way you get indemnity for less than three years service is if you are terminated from your job by the company.

I am currently working in a private company for almost 8 years now. Now I am planning to move out and look for another opportunity in the other company. How much indemnity will I get? and can I get a release immediately or should I wait for three months before they release me. Can my current company stop my transfer?
Name withheld
Answer: As far as indemnity is concerned you must get 15 days per year for each of the first five years and one month for each year after that. Please remember that the days for the first five years (75 in total) should be divided by 26.
Secondly, you have to give a 3-month notice and cannot move out immediately unless the company has no objection.
Lastly, the company can’t stop your transfer.
