Uncles, aunt acquitted of beating niece Citizen absolved in hit-and-run case

KUWAIT CITY, July 28: The Criminal Court of Appeals supervised by Judge Salah Al-Houti acquitted two citizens and a female compatriot of beating and threatening their niece.
According to the case file, the plaintiff filed a complaint against her uncles and aunt claiming she was beaten at their family home due to previous disagreement and during which she sustained injuries in various places of the body.
Attorney Abdulmohsen Al-Qattan said the plaintiff has been living under the custody of her mother, with the uncles and aunt for 18 years. He argued the plaintiff’s father had encouraged her to incite trouble with her uncles so that the court will withdraw the custody rights from her mother, due to continuing conflict between the parents.
Al-Qattan described the lawsuit as unfounded because there were no documents proving the allegations against the defendants.
It is worth mentioning the Court of First Instance had earlier fined the aunt KD 50 and the uncles KD 100 for allegedly beating and threatening their niece.

Citizen absolved: The Misdemeanor Court has acquitted a citizen of manslaughter in a hit and run incident.
Case files indicate the defendant was driving when he hit a pedestrian and the accident resulted in severe injuries to the victim which ultimately led to his death, as stated by Forensics report.
Moreover, the defendant neither stopped to help the victim nor called the Operations Room to come to his rescue, and he declined to report the incident to the nearest police station.
Defense lawyer Mishari Al-Ayada implored the court to acquit his client on the basis that he’s still young. He maintained the defendant’s parents are rather to blame for neglecting their child. He went on arguing his client was driving at the normal speed level when suddenly the victim appeared on the road, and he couldn’t avoid hitting him.
Al-Ayada said it was up to the victim to have made sure the road was clear before trying to cross, thus the elements of fault on the part of his client are weak.
