Termination & Notice Period

I joined my company in Kuwait on Nov 30, 2010.
I worked on till Jan 26, 2012.
On Jan 26, 2012 I left for my annual vacation to Mumbai.
My leave was approved by the company till March 23, 2012.
On March 19, I received a mail from my boss attached with a termination letter. He informed me not to return to Kuwait and added they would transfer all my dues to my account in India.
My salary for December 2011 and January 2012 was due with the company.
I wrote to them several times and called them but in the end I did not receive any results.
I planned a short trip to Kuwait and informed the company accordingly.
I met them and they are ready to pay my salary but they refused to give the 3-month termination notice salary.
Whom should I approach to resolve this matter?

The company is trying to avoid paying your dues. The company has to give you a 3-month notice or pay you for this period. It has also to give you a release. It can’t just say stay in India.
If the company refuses to pay you, you should approach the Labor Office in Behbehani Complex, Sharq and file a complaint.


Notice period


I have been working in the hospitality industry for 3-and-a-half years now. My line manager approved my resignation with the 1-month notice as I am willing to pay for the remaining 2 months of the notice period but our HR department rejected my resignation. I got a better opportunity which requires me to be on duty next month. I was hired abroad. What shall I do?

: The company can’t reject your resignation but it can reject the one-month notice. So you will have to give a 3-month notice if your HR dept so desires.
Until nearly 3 months ago, a person could give a short notice and pay for the remaining period even if the company was against it.
Now after the complaints from companies the Ministry of Social Affairs & Labor has issued a decision that no transfers will be allowed without the 3-month notice, unless of course the company gives its approval.
