Court acquits factory supervisor accused of murdering worker Shop owner’s KD 2,000 fine quashed
KUWAIT CITY, Aug 17: The Misdemeanor Court acquitted a factory supervisor who was accused of murdering an employee of the same factory and duty negligence in ensuring safety measures for the employees.
Defense lawyer Mohammad Al-Otaibi requested the court to acquit his client, explaining that even though his client was accused of not checking if the safety strap attached to the lifter was tight, it was the duty of the victim to ensure the strap was in place before signaling his supervisor to operate the loader, as is done normally.
Lawyer Al-Otaibi added that the supervisor usually uses the remote control to operate the loader after receiving the green signal from the victim.
He insisted that the testimonies of both the defendant and the victim needs to be obtained for the murder charges to be considered, since it was not possible to determine what really transpired prior to the accident due to lack of substantial evidences.
KD 2,000 fine quashed: The Misdemeanor Court rectified its verdict of charging a fine of KD 2,000 and instead obligated the owner of a meat shop, who was accused of illegally hiking the price of meat, to observe good conduct for six months.
Reportedly, Public Prosecution accused the defendant of hiking the meat prices with intentions of making more profits.
According to the case files, an inspector from Ministry of Commerce and Industry reported that while he was patrolling a few shops and companies in Shuwaikh, he was sold one kilogram of Arabian meat at one of the meat shop for KD 3, which indicated that the butcher had hiked the price illegally.
Defense lawyer Zaid Al-Khabbaz requested the court to disregard the charges, claiming that the defendant did not hike the price intentionally. He indicated that the inspector did not confirm the market price of meat before conducting the inspection and he did not quote the market price in the violation sheet.
2 brothers ‘acquitted’: The Misdemeanor Court, chaired by Judge Khalid Al-Omair, has acquitted a Kuwaiti and his brother of beating the former’s wife.
Earlier, the wife filed a complaint at the Public Prosecution, claiming that her husband and his brother took turns in beating her. She also presented a medical report to substantiate her claim.
However, the defendants’ lawyer, Attorney Faisal Al-Rasheedi, argued in court that the wife’s allegation is baseless. He said on the day of the purported beating, the wife suffered an undisclosed psychological problem and she even called the Psychiatric Hospital requesting for an ambulance, but when the ambulance reached the house she refused to get in and held on to the ladder, which then fell on her causing injuries in different parts of her body.
Al-Rasheedi also presented copies of the woman’s mental health records to the court, proving that she previously sought treatment for a psychological condition.
