My brother was transferred from an Article 22 to an Article 18 visa two months back. His company terminated him after two months and told him not to come anymore. Now they are pushing him to transfer to some other sponsor/company immediately. Fortunately he has found a sponsor and tried to transfer but the application was rejected by Shoun with remarks that residence cannot be transferred before one year (completes in July 2013).
The old company HR department is threatening my brother that if he does not do the transfer they will report him to police. The passport is with my brother.
My questions are:
1. What are my brother’s rights?
2. Can they cancel my brother’s visa?
3. What is a way out?

Answer: Please draw the attention of the Shoun (Ministry of Social Affairs & Labour) to the fact that your brother has been terminated and did not resign. If this is brought to their notice, they will sanction the transfer of your brother, which is his right once he is terminated.
