KUWAIT CITY, Jan 26: The Criminal Court, presided over by Counselor Mohammad Al-Sanea, acquitted two Kuwaiti citizens accused of trafficking and consuming hashish. The court found that the arrest and search warrant issued by the Public Prosecution was invalid due to lack of serious investigations. The case involved allegations that the accused had narcotics for trade and use.

Following secret investigations, the antinarcotics officers executed a search and arrest operation on February 14. The evidence, including narcotics and psychotropic substances, was reportedly seized from their residences in Abu Fatira, Egaila, and Hawally. Lawyer Ali Haider, representing the accused, argued that the arrest and search procedures were invalid because they were not supported by serious investigations, as required by Court of Cassation precedents. The court agreed, ruling that the invalid warrant rendered all evidence obtained inadmissible. The ruling underscores the critical legal standard that investigations must meet to ensure the validity of warrants and subsequent legal actions.
