Appeal Court overturns ‘Farwaniya Grave’ case verdict, defers sentencing

KUWAIT CITY, July 1: The Court of Appeal ruled to overturn the ruling of the Court of First Instance that ordered the imprisonment of the defendants in the “Farwaniya Grave” case for three years, two years, and one year with deportation, and ruled again to abstain from pronouncing their punishment.

The Criminal Court had previously ruled to imprison two defendants, a man and a woman, for three years with hard labor on charges of adultery and incest, to detain a third defendant for two years for selling abortion pills, and to imprison the building guard for one year for digging a grave and burying the fetus of the first and second defendants in the courtyard of a building in Farwaniya and making a grave for it. The court decided to deport the four expatriates after serving the sentence.

For his part, the defendants’ lawyer, Mohammed Al-Hamli, confirmed that the reason for cancelling the first instance court’s ruling was due to the invalidity of the legal procedures followed by the incident officer, which resulted in the absence of technical evidence, as he opened the grave and exhumed the body without the permission of the Public Prosecution, and in the absence of anyone representing the Public Prosecution during the exhumation of the grave and taking a sample from the body. The Public Prosecution was informed after these procedures were carried out, invalidating the technical evidence.
