Appeal fees hike stirs confusion; KBA team plans to file a complaint

KUWAIT CITY, March 19: Kuwait Bar Association (KBA) Chairman Adnan Mahmoud Abel stated that increasing appeal fees without a legal basis is a clear violation of the recent amendments, adding that this has confused work. In a press statement, Abel disclosed “We have contacted the Ministry of Justice regarding this matter to address it immediately.”

Abel said a team of experienced colleagues has been formed to prepare an appeal against the constitutionality of the recently approved fee increase; as it violates Article 166 of the Constitution, which prohibits restricting the right to litigation or creating a gap between litigants based on their financial capacity. He stressed the need to address the administrative procedures and backlog of appeals following the technical and legal frameworks established through the recommendations of the concerned committees and the association’s previous proposals.
