Contractor Ordered to Compensate Kuwaiti for Faulty Construction Work

KUWAIT CITY, March 15: The First Instance Court has ruled that a contracting company must pay Kuwaiti citizen 35,000 dinars, along with 7% interest from the date the lawsuit was filed until the payment is fully settled. This decision was made after it was established that the company had violated its contractual obligations concerning a construction project.

The Kuwaiti citizen had agreed with the contracting company to carry out construction work on his property per the agreed technical specifications and the timeline outlined in the contract. However, the company failed to fulfill its obligations, leading the Kuwaiti citizen to take legal action to safeguard his rights.

The affected party sought the counsel of attorney Dalal Al Mulla, who filed an urgent lawsuit requesting the appointment of a technical expert to assess the condition of the property. The expert's report confirmed that the work performed by the contracting company was defective, incomplete, and in breach of the contract. As a result, the case was referred to a substantive case expert, who concluded that the company's negligence was evident and that the citizen was entitled to financial compensation, including interest for late payment, calculated from the date the lawsuit was initiated until the full amount is paid.
