KUWAIT CITY, Nov 5: The Court of Cassation rejected the appeal submitted by an individual, who is serving a sentence of 15 years with hard labor, after being convicted of sexually assaulting a Russian woman who was exercising on a walkway in Salwa area.

The accused was referred to trial after the Public Prosecution charged him with sexually assaulting the victim on April 13, 2020. He was previously convicted by a court ruling issued during the year 2017 to a sentence of five-year imprisonment in another case. The Public Prosecution attributed to the accused that he proceeded to assaulting and raping the victim by choking her, beating her and pinning her resistance, causing her injuries described in the forensic medical report.

During the court session, the defense counsel of the Russian Embassy Lawyer Abdulmohsen Al-Qattan affirmed that the elements of initiating the crime of coercion against the accused were available, and all the actions that constituted the material and moral pillars of the crime were present.

He stressed that it was proven beyond any reasonable doubt that the accused had committed the crime attributed against him but the accused tried to deny the charges, claiming that he was unaware of his actions and behavior as he was insane. However, lawyer Al-Qattan said the submitted reports proved that his mental health at the time of the crime was sound. By Jaber Al-Hamoud Al-Seyassah Staff and Agencies
