KUWAIT CITY, May 30: According to the Court of Appeals, if a woman loses custody of her children due to her deviant behavior, it will not be restored to her even if years have passed since her action and even if the mother claims that she has rectified her behavior. The Court of Appeals overturned the verdict issued by the First Instance Court that returned to a woman the custody of her children.
The court instead ruled to retain the father’s custody due to the mother’s dishonest and deviant behavior, and because she did not seek to see her children until years had passed, because of which it is not permissible to remove the father’s custody. The defense counsel representing the father was Lawyer Hawraa Al-Habib, who confirmed to the court during her plea that the interest of the children was for them to remain with the father.
She highlighted that the passing of many years since the discovery of the mother’s deviant behavior does not restore her custody, even if she is upright as she claims. Lawyer Al-Habib said, “We encourage the mother to be righteous and repent, and we pray for her and extend a helping hand to her. However, she should not be given the right of custody, as she did not appreciate this blessing before. She was the one who neglected this right in the past, and we believe that it is in children’s best interest to remain with their father.”
