Court upholds KD 2,000 fine for Kuwaiti woman assaulting two doctors

KUWAIT CITY, Oct 27: The Court of Cassation has rejected an appeal submitted by a Kuwaiti woman and upheld the ruling to impose a fine of KD 2,000 on her for assaulting and insulting an Egyptian doctor and a Kuwaiti female doctor, as well as referred the civil suit to the concerned court.

The Public Prosecution had charged the female Kuwaiti citizen with assaulting two doctors - an Egyptian and a Kuwaiti - at Farwaniya Hospital. According to the complaint, the defendant was accompanying her grandmother when the Egyptian doctor requested a document to proceed with treatment. Kuwaiti female became angry and insulted him by saying, “Why are you interrupting me, you animal?”. She then struck him with her phone twice on his nose and chest, causing injuries to him as well as a female Kuwaiti doctor who was present in the Intensive Care Unit.

During the session at the Criminal Court, Lawyer Elaf Al- Saleh, who was representing Kuwait Medical Association, demanded maximum penalties be imposed on the defendant based on witness statements and the medical report. She also requested the acquittal of her client, the doctor, from any allegations. The court granted Lawyer Al-Saleh’s request, imposing a KD 2,000 fine on the defendant and acquitting the doctor. This ruling was upheld by both the Court of Appeals and the Court of Cassation. Lawyer Al-Saleh affirmed her commitment to prosecuting individuals who attack medical staff, in her role as a representative of the Kuwait Medical Association. She also demanded civil compensation from the convicted party for moral, ethical, and material damages.
