Employee Found Not Guilty of Theft, Breach of Trust in Jewelry and Pen Case

KUWAIT CITY, Feb 9: The Misdemeanor Court has acquitted an employee of a men’s accessories and collectibles company who was accused of breach of trust and theft involving gold jewelry and branded pens. The Public Prosecution had referred the accused for trial after investigating allegations that he had unlawfully taken possession of the entrusted valuables.

Defense attorney Abdulrahman Al-Muqaddam successfully argued that the prosecution failed to establish the key elements required to prove a breach of trust. He highlighted the lack of substantial evidence and serious investigative efforts, emphasizing that no conclusive proof linked his client to the alleged crime. Al-Muqaddam explained that, for a breach of trust conviction, both the material and moral elements of the crime must be established. However, in this case, neither element was present.


He further elaborated that the crime of breach of trust requires clear criminal intent, meaning the accused must have deliberately taken possession of the items with the intent to embezzle them. In this instance, no evidence demonstrated such intent. Additionally, the charge requires proof that the accused knowingly misused, squandered, or took ownership of the entrusted property to harm the victim, which was not substantiated in court.
