KUWAIT CITY, Feb 16: The Civil Court of Appeal has upheld a preliminary ruling that compels an expat to pay KD 30,000 in temporary civil compensation to a maid for detaining and torturing her at his residence in Mubarak Al-Kabeer Governorate. The case was represented by lawyer Mohammed Al-Ajmi, who argued for the maximum penalty against the accused for his crimes, which included torture, unlawful detention, and causing injury to her body by burning the victim. The court deemed the compensation justified as legal blood money, acknowledging the severe material and moral damages inflicted on the plaintiff, as well as the 25% permanent disability she sustained, which affected her overall physical capacity.
In her lawsuit, the plaintiff revealed that she had already secured a final and binding criminal ruling against the accused, sentencing him to three years and four months of imprisonment with hard labor, followed by deportation from the country after serving his sentence. The charges against him included assault and unlawful detention. The maid recounted that after four years of working in the defendant’s household, specifically from 2021 until early 2022, she was transferred to the care of his wife. During this period, the defendant began subjecting her to physical abuse, beating her with his hands, wooden sticks, and aluminum rods under the pretext that she was working too slowly.
She further detailed how the accused restricted her freedom by locking her in her room and denying her access to food. Her ordeal continued until she was eventually taken to the hospital, where she reported being detained and tortured. Medical examinations confirmed that she had sustained multiple injuries, including broken elbows, underscoring the severity of the abuse she endured. The court’s decision to uphold the compensation reflects the gravity of the defendant’s actions and the lasting impact they have had on the victim’s life.
