KUWAIT CITY, Mar 9: The Court of Cassation overturned the verdict issued by the Court of Appeals, which had obligated a woman to pay KD 20,000 to her husband because she received his monthly salary. The man had filed a lawsuit against his wife and the bank, requesting a ruling to appoint an expert to visit the bank and verify that the wife had received KD 20,000 without justification. He also sought to compel the bank to submit the agency/ authorization that allowed her to receive those funds from his account, and to determine whether the authorization granted her the right to collect the money.
The husband claimed that his wife had seized the specified amount with the help of the bank, based on an authorization in her capacity as his agent under an official power of attorney. In response, the wife’s defense argued that the appeal was based on a violation of the law, an error in its application, and a deficiency in reasoning. The power of attorney issued by her husband granted her the authority to perform all legal actions outlined in the document, as well as actions not specifically mentioned. It was an absolute general power of attorney, meaning that the husband ratified, from the time of its issuance, all actions taken by her or her representative.
