‘I do’ now tied to health check

KUWAIT CITY, Feb 9: The Ministry of Health in Kuwait has approved the executive regulations for Law No. 31 of 2008, which governs premarital medical examinations for individuals wishing to marry.
These regulations, issued under Ministerial Resolution No. 23 of 2025, will take effect on April 1, 2025, reports Al-Seyassah daily. Key Provisions of the Executive Regulations:

Premarital Examination:
A medical examination to detect genetic and infectious diseases, aimed at advising individuals about potential risks of transmitting diseases to the partner or future children.

 Premarital Medical Examination Center:
Centers run by the Ministry of Health where individuals undergo their premarital medical examination.

Safe Marriage:
A marriage where the premarital examination results are free from any medical issues.

Unsafe Marriage:
A marriage where the results of the medical examination indicate potential health risks.

Electronic Platform:

A digital system for facilitating premarital medical examination procedures through approved applications like the Sahl and Kuwait Health apps.

Required Medical Examinations:

Those wishing to marry must undergo tests for:

- Infectious diseases: AIDS, Hepatitis B and C, Syphilis.

- Hereditary blood diseases: Thalassemia, Sickle Cell Anemia.

- The Minister of Health may add other diseases as necessary for public health.

Examination Procedures:
- Applicants must visit a premarital medical examination center to submit necessary documents and fill out forms confirming the accuracy of their data.
- If any applicant acknowledges genetic diseases, they will be referred to the Genetic Diseases Center.
- Blood samples will be taken from both parties, with results typically available after five working days.

Results of the Medical Examination:

- If the results are clear of diseases, a certificate will be issued confirming that the marriage is safe.
- If any health issues are identified, the concerned individuals will be provided with medical advice. If they choose to proceed with the marriage despite the risks, they will sign a declaration of consent acknowledging the health risks involved.

This declaration must be submitted with the marriage documents to the Ministry of Justice.

General Provisions:

- A marriage contract cannot be completed without undergoing the premarital medical examination.

- In the case of inaccurate test results, consent from minors will not be accepted without parental representation.

- Kuwaiti embassies abroad will not authenticate marriage contracts unless premarital medical exams are completed.

- The validity of the medical examination certificate is six months; a new examination is required if the individuals change.

- The Ministry of Health will set up a higher committee to oversee and ensure proper implementation of these regulations and policies.

These regulations aim to safeguard public health by ensuring that those planning to marry are fully aware of potential genetic and infectious risks, contributing to the creation of healthy families in Kuwait.
