‘Issue ownership documents to divorcee’

KUWAIT CITY, Feb 1: The Court of First Instance has ordered the Public Authority for Housing Welfare (PAHW) and the Real Estate Registration Department at the Ministry of Justice to issue a home ownership document to a divorced Kuwaiti woman even though they had initially refused to do so. The court confirmed the citizen’s right to receive the ownership document without the need for approval from her ex-husband.

The plaintiff filed the lawsuit through her legal counsel Lawyer Ali Al-Wawan to challenge the Director General of PAHW and the assistant undersecretary for Real Estate Registration and Documentation at the Ministry of Justice and request a ruling that would allow her to proceed with the necessary steps for the issuance of the ownership document for the plot shared equally between her and her ex-husband without requiring his signature.

In this context, Lawyer Al-Wawan clarified that his client was married to the first defendant under a valid legal contract and has children with him. They had applied for housing care from the second defendant (the Justice Agent), and the plot was received in 2004. However, due to the defendant’s negligence in issuing the ownership document, and his arbitrary refusal to do so, the plaintiff filed the lawsuit.
