Jail time, fines for cash vehicle sales in Kuwait

KUWAIT CITY, Sept 21: The official gazette, Kuwait Al-Youm, has published the decision of Commerce and Industry Minister Khalifa Al- Ajeel to ban cash transactions for vehicle sales and brokers selling light and heavy vehicles on commission. The decision takes effect three days after its issuance. Article 13 of the Decree, as amended by Law No. 117/2013, stipulates that violating the decisions issued in line with clauses one and two of Article One of this law shall be fined not less than KD100 and not more than KD1,000.

Violating decisions issued in line with clauses three and four of the aforementioned article shall be punished by imprisonment of not less than one month and not more than two years, and a fine of not less than KD500 and not more than KD5,000 or any of these penalties, along with confiscation of goods and tools. It is permissible to confiscate the vehicle used in committing the crime without prejudice to the rights of third parties.

Violating decisions issued in line with Clause Two of the same article shall be punished by imprisonment of not less than one month and not more than six months and a fine of not less than KD50 and not more than KD1,000 or any of these penalties. Violating decisions issued in line with Clause Three of the same article shall be punished by imprisonment of not less than three months and not more than three years and a fine of not less than KD500 and not more KD3,000 or any of these penalties.

Without prejudice to Article 73 of Penal Code No. 16/1960, it is permissible to close the establishment where the crime occurred for a period not exceeding three months or to cancel the license and close the establishment permanently.

In case a crime stipulated in this law is committed, the minister will order the closure of the establishment until the case is adjudicated. After hearing the opinion of the Ministry of Commerce and Industry, the Public Prosecution or the court may authorize opening the establishment upon the request of interested parties. The penalties for the crimes stipulated in this law shall be doubled in case of recidivism, along with the cancellation of the license and permanent closure of the establishment
