KUWAIT CITY, Jan 25: The Criminal Court ruled that it is not permissible to try a Kuwaiti citizen, accused of premeditated murder, due to his mental illness and his admission to a psychiatric hospital. The defense team representing the citizen appeared before the court and requested that he be referred to psychiatry to examine his mental abilities. The defense’s request was accepted, and it was revealed during the tests that he suffers from severe schizophrenia. During the incident, the citizen was irresponsible in his actions, unaware of the nature of the act he committed from a moral and legal standpoint, and of the consequences. His defense team stressed that the accused was not responsible based on Article 22 of the Penal Code, as evidenced by the statements he made and the reality of his actions and public life. Accordingly, the court ruled that the accused was not responsible based on the psychiatric report.
