Litigant qualified, has right to teaching

KUWAIT CITY, Feb 4: The Administrative Court of Cassation has denied the Ministry of Higher Education and Kuwait University’s request to suspend the enforcement of a Court of Appeal ruling that annulled the appointment of a teaching assistant at the College of Administrative Sciences for the 2022-2023 academic year. The case, represented by Attorney Mohammad Ahmad Taleb on behalf of a civil engineer applicant, challenged the exclusion of his client from the teaching assistant position in the Department of Information Systems, Operations Management, and Supply Chain, despite meeting all required qualifications.

The applicant held a Master’s degree in civil engineering from Kuwait University with a GPA of 3.97 out of 4, had lectured internationally, possessed over 11 years of experience, and had been accepted unconditionally by two universities. Initially, the Administrative Court dismissed the lawsuit. However, upon appeal, the Court of Appeal overturned this decision, citing procedural errors and invalidities in the selection committee’s formation and decisions. The Ministry and University subsequently sought to halt the implementation of this ruling, but the Administrative Court of Cassation’s recent decision has affirmed the annulment, reinforcing the applicant’s right to the position.
