KUWAIT CITY, Jan 26: The Fourth Commercial Section in the Court of Cassation obligated the owner of a commercial complex to pay KD 126,000 to an investor – the rent paid by the latter; because he did not benefit from the leased property, reports Al-Seyassah daily. Lawyer for the investor, Attorney Muhammad Al-Jami, said his client obtained a license from Kuwait Municipality to demolish and rebuild the property for investment purposes. He disclosed that his client and the defendant agreed on turning the property into a restaurant and café, finish and equip it at his expense.
This is in addition to his commitment to obtain the necessary licenses to carry out the agreed activity in accordance with the applicable laws, and that the term of the contract is five years renewable. He disclosed the agreement was for his client to pay KD13,500 every three months; starting from the date of signing the contract. He added the ownership of the building, finishes, improvements and modifications made to the property upon the termination of the relationship between them are clearly stipulated in the contract.
