KUWAIT CITY, Dec 5: The Minister of Justice and the Minister of State for Housing Affairs Faleh Al-Raqba issued resolution No. 138/2023 regarding the issuance of the executive regulations of law No. 118/2023 for the establishment of companies to build cities and residential areas and d e v e l o p them economically. In a press statement issued Sunday, the Public Authority for Housing Welfare (PAHW) said the decision included a set of steps that contribute to implementing the various articles of the law, in response to Article 39 of the law, which stipulates the necessity of issuing the executive regulations of the aforementioned law from the concerned minister.

PAHW explained that the new regulations focus on identifying aspects of cooperation and partnership with the private sector, and benefiting from the law and turning it into reality, by launching a series of projects that provide housing care, in support of the development visions and plans of the Council of Ministers. The regulations include 16 chapters with 84 legal articles that cover the mechanism for implementing housing projects, either in the form of a city or an area. They will enter into force immediately upon their publication in the official gazette. The articles of the regulations also cover projects from the time they are an idea until the of their presentation, then select the winning investor, and establish a public joint-stock company, as the case may be.

The regulations touched on how to implement projects, their quality, and work items accurately, while guaranteeing the rights of those entitled to housing care and beneficiaries, as well as the duties and obligations of the company in operating, managing, and maintaining the project until the end of the contract period.

The regulations contain several procedures related to re-introducing projects after the end of the contract period of the companies benefiting from them, in addition to regulating the building regulations and issuing their licenses. PAHW is continuing to cooperate and partner with various agencies in the country to achieve more steps that contribute to providing housing care for citizens and increasing its size in line with the country’s development plan.

Meanwhile, the Ministry of Public Works has signed a contract for the maintenance of service sectors, roads and squares of State institutions in the Farwaniya, Capital and Jahra governorates (contract number QS/T/453) with an undisclosed company valued at KD1.7 million, reports Al-Anba daily quoting reliable sources. Sources said the contract period is 1,095 days and this tender was awarded to the winning company on Jan 18 in order to comply with the technical conditions and specifications as per the approval of the concerned authorities.

According to the terms of the contract, the contractor is obligated to complete the work in accordance with the conditions stipulated therein. The contractor is also obligated to guarantee and maintain the works that are the subject of this contract for a period of 1,825 days from the date specified in the initial handover certificate. Before concluding the contract, the contractor submitted to the ministry the final insurance equal to 15 percent of the total value of the contract and this insurance is valid for 3,010 days from the date of its issuance and throughout the period of completion of the work, including the warranty for maintenance period, plus three months, as insurance and guarantee for the implementation of the contract.
