Negligent foster mom hit with KD 4,000 fine

KUWAIT CITY, Jan 13: The Misdemeanor Court has fined a foster mother KD 4,000 for her behavior on social media, which were deemed to harm the principles of motherhood and the rights of the child. The court also ordered her to pay compensation of KD 2,000 to the child’s father. According to the case details, the plaintiff's counsel Lawyer Hisham Al-Fahad accused the foster mother of negligence in caring for the child by leaving him alone in the residence where he stayed with her, while she traveled abroad without notifying the father, the complainant. As a result of her absence, the child missed school after the official holiday without any valid excuse.

She also endangered the child’s safety by purchasing an electric scooter for him, which he used on public roads outside the area. Lawyer Al-Fahad explained that his client, the child’s father, was shocked to find his child alone in the street opposite his house, and carrying heavy bags containing his clothes and belongings, allegedly because of the foster mother’s anger toward him, and for not informing him of her actions. This left a negative impact on the child’s mental health and caused him to suffer from involuntary urination. Also, the foster mother allowed the child to go to the chalet of a strange man to spend the night there without the father’s permission or consent. She also used the child’s name in her commercial activities. The child developed morbid obesity due to the foster mother’s preoccupation with commercial advertising and frequent travel, rather than focusing on the child’s well-being. The court, after reviewing photos of the accused posted on various social media platforms, concluded that they were shameful and led to the firm conviction that the accused had abandoned the principles of motherhood and the care of her son. Instead, she appeared to be chasing worldly desires, and neglecting both her reputation and her child’s well-being.

According to the court, while most mothers focus on caring for their children at night, the accused have been taking photographs in questionable places, fully adorned and indulging in fleeting pleasures. How can a woman who exposes herself to different people on social media neglect her responsibilities as a mother, especially when her son is still young and should be protected from such shameful behavior? The accused has been engaging in such actions for some time, and this raises serious concerns about her ability to care for her child. The judiciary, after thoroughly examining the case, has the right to convict and punish the accused. It has been conclusively proven that she committed the actions attributed to her, as outlined in the relevant legal provisions. Per Article (1/172) of the legal procedures, the court has issued a conviction. The court called on the accused and others who may follow her example after a divorce to be mindful of their actions. They should fear Almighty Allah, first for their own sake and then for the sake of their children, and refrain from engaging in the trivialities of social media platforms.
