New law changes fees and appeal rules for administrative disputes

KUWAIT CITY, Sept 15: Decree-Law No. 94 of 2024, recently issued and published in the Official Gazette, brings changes to the provisions of Decree-Law No. 20 of 1981 concerning the establishment of a department within the General Court to handle administrative disputes.

The decree amends Articles 11 and 12 of the original law. According to Article 1 of the new decree:

Article 11: A fixed fee of 100 dinars is now required for cancellation and suspension requests. This fee will be multiplied by the number of decisions and requests involved.

Article 12: Rulings from the Administrative Division of the Court of First Instance may be appealed if the dispute is of undetermined value or exceeds 10,000 dinars. Rulings on disputes below this threshold are considered final.

Additionally, the amendment introduces two new articles to Decree-Law 20/1981:

Article 12/bis: Rulings from the Court of Appeal, based on Clause Four of Article One of this Law, are final, except in cases involving dismissal or removal from service.

Article 14/bis: Rulings from the administrative departments of the Court of Appeal can be appealed by cassation if the dispute's value exceeds 30,000 dinars or is not estimated.

These updates aim to streamline administrative dispute resolution and clarify the appeals process.
