Real Estate Company Ordered to Pay KD 280,000 Over Chalet Ownership Violation

KUWAIT CITY, Oct 14: The Commercial Court has ordered a real estate company to pay KD 280,000, which is the value of a chalet in the “Pearl of Khairan”, to a Kuwaiti citizen. It also ordered the cancellation of the sale contract. According to the case file, Lawyer Ali Al-Ali, who was representing the plaintiff, explained that the first defendant sold the chalet to his client, who paid the full price of KD 280,000. However, his client was surprised to find that ownership had not been transferred due to violations associated with the chalet, which resulted in financial loss and moral damage as she could not utilize or invest in the property. The second and third defendants are partners in the first defendant's company.

Before ruling on the case, the court referred the matter to the Experts Department at the Ministry of Justice. The department appointed a specialized expert to investigate. The expert submitted a report detailing new violations in the property that contravened the approved plan from Kuwait Municipality, suggesting that these violations were the reason for reversing the ownership transfer to the second defendant. The report concluded that the second defendant was responsible for the violations, which hindered the transfer of ownership.
