Stricter Rules Introduced for Employee Termination Requests

KUWAIT CITY, Aug 31: The Undersecretary of the Ministry of Education Mansour Al-Daihani has approved new guidelines for all ministry employees regarding requests for termination of service. The decision issued by the undersecretary in this regard addresses issues related to incomplete applications for service termination within the Administrative Affairs and Administrative Development Sector.

It reflects the ministry’s commitment to ensuring that employees do not lose any of their benefits when requesting to end their service either through resignation or retirement. It aims to prevent employees from losing benefits due to a lack of awareness, which could adversely affect their retirement pension.

The decision issued by the Ministry of Education outlines specific guidelines for employees requesting to end their service:

1. Review of Retirement Entitlement: Employees must consult with the Public Institution for Social Security to verify their retirement pension entitlement before submitting a service termination request. They should also bring a recent salary certificate.

2. Submission Procedure: Requests to end service must be submitted at the employee’s work center and approved by an authorized individual according to ministerial decisions. The request must be signed by the employee or their authorized representative, specifying the resignation or retirement date. Requests will not be accepted if submitted after the specified termination date.

3. Request Date and Leave Balance: Requests with a submission date after the termination date will not be accepted. The leave balance must be recorded in both letters and numbers and approved by the competent authority. Applications with manually modified termination dates will only be accepted if approved by the authorized person.

4. File Review and Timing: Employees should review their file with the termination of service department in their educational zone to ensure they have completed the required retirement period. Requests should be submitted at least one month before the desired termination date to allow sufficient time for processing.

5. Supplemental Benefits and Insurance: Employees seeking benefits under Articles 1 and 42 of Law No. 8/2010 regarding the rights of persons with disabilities or those who wish to subscribe to the optional supplemental insurance as per Minister of Finance’s Resolution No. 7/2019 must:

Submit an electronic request through the Ministry’s website.
Obtain approvals from the Public Authority for Disability Affairs and the Public Institution for Social Security.
Attach these approvals to their official termination request.

6. Service Period Verification: Employees who have been on mission or study leave must ensure they complete a similar period of service upon return to avoid financial consequences as outlined in Article 32 of Civil Service Council’s Resolution No. 10/1986. They must also ensure that decisions regarding their delegation are confirmed or canceled before submitting a termination request.

7. Leave Coordination: Employees must ensure that they do not submit any leaves that conflict with the termination date. All submitted leaves must be approved before the termination request is made. Coordination with the Leaves and Attendance Department is required, including providing a leave extract for the last three years of service and obtaining clearance from the Supplies and Warehouses Department if applicable.

8. End-of-Service Bonus: Non-Kuwaiti employees with a second contract must submit their termination request at least one month before the contract end date to avoid losing part of their end-of-service gratuity. For terminating the contract, the request should be made three months before the service end date as stipulated in the contract to avoid losing a quarter of the gratuity. Employees must continue working until the termination date and avoid unapproved absences that could delay the end of- service gratuity.

The Ministry urges all employees to adhere to these guidelines to ensure the protection of employees’ rights.
